Federal Phase II Storm Water Regulations - What Do They Mean for Fargo and Moorhead?

As a result of the 2000 Census, Fargo and Moorhead are each classified as regulated owner/operators of small municipal separate storm sewer systems (MS4s). Small regulated MS4s, including Fargo and Moorhead, must now fulfill several requirements to obtain permit coverage under the Federal Phase II regulations. These requirements include the development of a Storm Water Pollution Prevention Program (SWPPP). This program must be renewed every five years and must address six required elements, called minimum control measures. The minimum control measures include:

  1. Public Education and Outreach on Storm Water Impacts.
  2. Public Involvement/Participation.
  3. Illicit Discharge Detection and Elimination.
  4. Construction Site Storm Water Runoff Controls.
  5. Postconstruction Storm Water Management in Areas of New Development and Redevelopment.
  6. Pollution Prevention and Good Housekeeping Measures for Municipal Operations.

Phase II Federal Regulations and the Fargo-Moorhead Area - What's Happening?

The cities of Fargo and Moorhead have each completed their individual SWPPPs and gained compliance for their storm water discharges through the appropriate permitting authorities in North Dakota and Minnesota. To save valuable resources and increase efficiency, Fargo and Moorhead have joined with other MS4s in the Red River Basin to participate in the Regional Storm Water Coordination (RSWC) Program.
